Info Wanted: Why go BLU - Fanedit Lover's Obligation???
Time

nightstalkerpoet said:

I was just curious about this from a legal standpoint. As faneditors, we have an obligation to avoid breaking the law with our works. This is done by not selling edits for profit and by MAKING SURE ANYONE WHO VIEWS THEM OWNS AN ORIGINAL COPY.

Up until this point, there has been no "Official" retail copy of Star Wars available for purchase in a high definition format. Thus, when downloading edits or preservations in HD (from HDTV copies), owning the DVD copy has been the legal basis for being able to view these edits.

Now that the Bluray copies have been released, doesn't that mean that anyone who downloads a high-definition source edit should be required to own a high definition retail copy to fulfill that same legal obligation?

Yes. Why? Let me put it this way:

If you were to acquire a 4K digital copy of the film, you would have acquired it illegally as it is NOT available in that format.

An example: The fanedit "Two Towers: The Purist Edit" was made using an unofficial copy of the film, and although the editor and viewers had the DVD copies, NLC/WB cracked down on the fanedit due to its original source material.

In terms of DVR recordings of Star Wars in HD, the law in the USA is that you have to delete it after 24hrs (in Canada you can have it as long as you don't distribute it - unless they are musical broadcasts, in which case I think there's some weird clause where you can give away three copies).

Because Star Wars was NOT available in HD, I'm assuming that is why Lucas Films did not crack down on the fanedit community - however, now that they are available, this changes things. The game has changed.

So with all that in mind, the real question comes down to your moral judgement, but the big hullabaloo being projected earlier was that poster should NOT be encouraging a "boycott" on the release and still ACTIVELY say they will not only be downloading the HD version of fanedits, but that they will also donate the money they would have given to Lucas, instead to the faneditors.

Downloading and distributing fanedits is technically illegal and you could get sued either way, but we're yet to face a problem when these things were followed:

  1. The film is not distributed to those who do not own the source material.
  2. The film is not received by those who do not own the source material.
  3. The film is not edited unless the editor owns the source material.

Whether or not you buy the BD release is your call, but to wave a big flag saying "Fuck you Lucas, fanedits are getting my money - and for HD versions of your films!", you're not only putting yourself at risk, but the faneditors, and even entire fanedit community at large.

So as long as you STFU about it, we (the community; I couldn't care less about those breaking copyright) should be fine - but keep in mind, the OFFICIAL stand point of the fanedit is to OWN the films.

Is ady even using the BD as his source?  Considering when he started the edit, I assumed he was using the HDTV broadcasts, and if that's the case there would be no need to buy the Blu in order to download this once it's ready.

I really don't see this getting shut down because a few people say they aren't going to buy the Blu and donate to adywan instead.

The issue with that is that broadcasts of films can only be kept for 24hrs after air date (at least for content coming out of the States - there may be some way to get around it in the UK that ady took advantage of), but the issue isn't just owning it vs not, but broadcasting that you want to boycott it and give that money ONLY to ady's project. It takes MORE effort to publicise a boycott like than than to just not comment on it.

BTW, I agree, buy them or not, that depends on your own morals/sense of right and wrong, but if you're not, shut up about it, geez.

That's exactly what I'm saying. Whether or not you ACTUALLY buy them is up to you - but don't start openly encourage people to NOT buy the Blu-ray and then say how you are going to give the money you were going to give to Lucas, to adywan. It's just a bad idea all around. If you don't want to buy the Blu-ray and still get ady's HD version, that's up to your own morality, but again, don't go around boasting that.

Well, in my opinion, if your already paying monthly to watch the current HD versions through your local cable/ satellite supplier, then I feel you don't have to buy the Blurays to own adys edit. They are all being shown through my Cox Cable supplier pretty frequently, and I can always DVR them.

And 24hrs after recording them, it's illegal to still be in possession of them. Just buy the Blu-rays...

Oh, so somewhere this went from a simple little, not-as-much needed as ANH-edit, to a complete overhaul. But isn't the 2011 ESB already 90% perfect? Anyway, I'm sure this edit will be great!

Since the Blu-Rays suck, everyone should just give Adywan the $100 bucks they would've paid for the Blu set, so he can finish up this and ROTJ, then do the prequels too. I was hoping Lucas would give us a perfect, no plot-holes, error-free version of the Saga. But since that seems like it will never happen, Ady will have to pick up the slack. I haven't even seen ANHR, yet, but just going by word-of-print (instead of mouth) and 005's Google images, it seems awesome!

The unfortunate thing is that in order to legally HAVE these movies in HD, you have to OWN an HD copy of the films. I'm not even sure how ady was able to get a legal copy of ESB in HD, but that's none of our concern anyways. For all we know, a Fox exec could've given it to him - but regardless, I like to believe that they KNOW of ady's efforts, and support them because they keep the interest in Star Wars going. However, if (as a fan-edit community) we all decide to boycott the Blu-Rays in support of ONLY ady's films, I can guarantee that it will only make hell for ady. By all means donate to ady, but also buy the Blu-ray - if you decide NOT to buy the Blu-ray and ONLY get ady's films, that's a personal choice, but don't go around posting it everywhere because then adywan (and possibly even all other faneditors) will start getting in to legal trouble.

Regardless of the poor choices made with the Blu-ray, at least buy it in order to have the legal right of also owning ady's HD versions.

First id like to thanks Aluminum Falcon for the links to download, thanks again!

Asteroid-Man, I had been following your project for quite a while now although i had never posted. It was well worth the wait.  From the opening title cards and the senator arriving on Coruscant to the custom end credits, what an enjoyable 3 hours ride. Watching it again tonight with friends. Looking forward to a dvd release. Having only watched it on my 21" monitor on my pc, the video was well edited and i found no problems with cuts or audio. A job well done. Looking forward tonight to see it on my 55"

Woah, that actually means a lot to me! Thank you! I hope you guys enjoy it!

Just a quick update; the DVDs have been shipped out to FE.org, and once they receive it, they'll upload it within a day. When I tried to remove that flash-frame from the DVD, the file got HUGE for some reason, so that flash frame is still on the DVD unfortunately (I think it happened during the pull-down render or something) - that flashframe is NOT on the digital copy though (although the Digital Copy is only like 80% of the quality of the DVD).

Hope you guys enjoy!

TRON: LIBERTY *** QUICK UPDATE *** (* unfinished project *)

For those of you wishing to donate for material for any of my independent film making (which would also be used for future fan-edits), I've devised an easy method: T-Shirts.

I like this method as you're actually buying a T-Shirt which will promote my work, and all the profit (which is only $2-$4 a shirt) will go towards future endeavours.

Obviously it will accumulate VERY slowly though.

Many have PMed me about donating and I never accepted it - now I am willing to accept. My edit is released, which means people can actually see how I work. Also, I am actually in need of certain equipment (a BluRay player/burner, maybe some more RAM or a new CPU (this depends though; my computer has been getting VERY laggy while editing, so once I reformat the computer we'll see if it keeps up or not). Once that equipment is acquired, I'll post an update stating so.

On the T-Shirt store you'll find Asteroid Productions shirts, Renascent shirts, and some random graphic tees.

As I still don't have money of Tron and Tron: Legacy in HD, I'm trying to unpack that old MKV HD file I had. I'm using Avidemux - I've unpacked it and it wouldn't work in Vegas, so now I'm converting it using Avidemux. It's taken about 24hrs and I'm 97% done that. If it loads in Vegas, then we're back in business. Once I get started on this, it's full force (as I'm done with Renascent until the release of ESB: Revisited).
