Dark Jedi and I discussed this release at great length before posting, and our interpretation of the rules was that this release clearly fell into the Preservation category. I believe Dark Jedi's reputation also speaks for itself, in terms of what he has done for the Fan Edit and Preservation community; in short, he deserves to be heard and to get cut some slack.
Under the following rule of originaltrilogy.com, I believe Flash Gordon falls into this category:
3. What is a custom DVD?
A custom dvd contains a film essentially the same as a retail release, but with differences in technical details such as sound mix, picture quality, and so on.
Examples:
Japan cut of Kill Bill Vol. 1 with English subtitles only on Japanese dialogue
Star Wars Episode III with comedy "backstroke of the west" subtitles
Any DVD released in letterboxed widescreen converted to anamorphic widescreen
DVDs with an alternative soundmix
The Flash Gordon NTSC DVD is long out of print, and was a shoddy release. Dark/Cassidy's version, which was a conversion of the PAL DVD, featured improved picture quality and an unavailable Dolby Digital 2.0 mix, custom artwork and several rare items on the DVD-ROM.
Dark Jedi and I worked extremely hard on this release, and after much discussion we are curious as to how this project differs from any of the Star Wars fan preservations, in principle. We feel that this release, and ultimately us, are being treated unfairly.
Neither one of us is looking to pick a fight but would like an explanation of the deletion of any mention of the project, Flash Gordon PAL2NTSC, and a clarification of the rules.
