Agreed with ApolloOne. Not all DVD players are created equal. One must consider the greatest common factor when burning a DVD.

Here's a reason why I do not believe in using torrents to get the STAR WARS Trilogy original versions...a story broke on the news today that the MPAA and the major movie studios are taking action against torrent sites and torrent users. One such site was forced to come down because of this activity. Think about it, and watch out.

Reading up on the LokiTorrent shutdown (I never even went to their site before) ... curiously the owner has agreed to turn over all logs. Is this paving the way for the MPAA to go after the individual and not just the server? Will other torrent sites begin to routinely prune their logs as a result?

I hate to tell you, it could very well lead in that direction. They could even shut down MySpleen.net if they wanted to and go after their users. Star Wars fans beware.

I'm not afraid of the MPAA. But then I don't use torrents... even if I did the MPAA does not worry me in the slightest.

As long as you have an official version of star wars on vhs,vcd,ld or dvd they can't touch you. You bought the right to the licence to play back that material. AND your entitled to own a backup. End of story.

Though that isn't 100% true, it would make the case much harder to prosecute. You'd actually be better protected if you had a laserdisc than if you had a copy of the DVD. Since the majority of the OT backups are from laserdisc, you could easily argue that you have an archival copy.

Concerning the Lokitorrent logs, I read somewhere that these logs that were turned over to the MPAA actually contained virtually nothing that could incriminate someone. It showed an IP and it showed that you downloaded a *.T0RRENT. You're not breaking laws for downloading a torrent and they cannot prove that you downloaded copyrighted material.

Regarding myspleen: it is basically a repository for television shows, usually ones that aren't on the air anymore. To use the hackneyed argument, threatening legal action against them is like declaring VCRs illegal.

No, I am not entitled to own a backup without express permission from the copyright holder. However the MPAA has no jurisdiction over me, so they can go and rot in America. In Canada file-swapping is legal.

Not only are these backups for many of us, they are movies that have been publicly disowned by the creator. This isn't the version he ever intends to sell again.

I can see the MPAA being very concerned about people downloading new movies playing theatrically and actual DVD rips of items that are for sale, but when the owner says that a title doesn't exist anymore and it's been supplanted by something else, that creates a tremendous gray area.

That is one of the four tests when deciding whether fair use applies: the impact such use has on the market or value of the copyrighted work. Make sure the judge has Star Wars toys in his chambers, though, just to be on the safe side.

Mysteries" Edition was posted on the torrents the creator[s] anonymity was
partially broken...

First, there was a quoted email that was posted on OT.com forums that gave us
insight into all the wonderful and juicy details of this sets conception; along
with a technical walk-through of the eventual results. A few days later I
received a very wonderful email from a member of the EditDroid team that
requested that the moniker that we (my brothers and I) gave this now highly

I think what is important is that a federal judge ruled regarding the Digital Millennium Copyright act that as long as the material in question is no longer available, the DMC does not apply.

This is why MANY video game manufacturers are bring ancient arcade games out for PDA's, Cell Phones, Portables, etc. Otherwise they lose the protection of their copyright.

One could argue that the OT no longer exists in any format and is therefore legally available for those in need of a backup copy.

The DMCA is a subset of all copyright law, one whose main purpose is to update the law for the digital age. Even if the DMCA doesn't apply, traditional copyright law could still be used. Or in Jurassic Park terms, you might get by the velociraptor, but you still have to face the t-rex.
