Checked and looks like I had the wrong file, keeping all the working files in the same folder with the same name is not a good idea then...

I do not have the audio drift but it has the jerks, I think going with the 25fps and reconverting the FPS is the way forward anyone suggest a better program to convert?

depending on which file you want to make the framerate change with.

original h264 cap video - use eac3to
transcoded working video - use your nle if it can do it
final transcoded output file to h264 - use eac3to

Working on getting it perfect but just started a new job will update soon but no way I am taking it down again due to a bad encode from me :)

You should decode your HDTV cap and use AviSynth to change the frame-rate.  Then render a lossless intermediate, apply your color grading, and re-encode.

Got a file that plays perfect in VLC and barely at all in MPC.....

This was on HDNet Movies last night (or the night before). It sure was grain scrubbed. But if all the releases are grain scrubbed, there is nothing we can do to fix it. Like with PATTON we will have to hope and pray for a new release.

 That sounds alright to me. If you release it, some member might be able to see what's going wrong. (And if not, it plays in VLC.)

Ok got the video at 23.976 and the 5.1 track synced added the commentaries but cannot for the life of me get the mono to sync!
