In response to the thread title: Yes. For many reasons.
1. Money
2. PR. If Disney doesn't release the OOT, they're no better than GL. If they do release the OOT, the fans will see them as gods.
3. Disney wanted "complete and unfettered control.", and there's no way any corporation would sign a contract to never release their own intellectual property.
