Jay, if Dayv cannot supply documentation that is RELEVANT TO HIS CASE, then he is a fraud.  Plain and simple.  It is WAY too easy to cook up documents that appear to have a doctor's letterhead on them, especially for someone that is a graphic designer.

Also, a doctor will not have any trouble discussing the basics with someone if authorized by the patient.  ESPECIALLY if there is potential for criminal proceedings.

So yes, I call bullshit.

This all blew up while I was away from the boards and has been locked down since I've been back. I have like everyone here been waiting for confirmation from Jay of the information that DAYV promised to send him.

While it's true that DAYV didn't request money he did describe a terrible situation (a treatable but otherwise terminal illness that was not being addressed because of lack of funds).

I suggested a thread like this because DAYV had done similar things for other members in crisis and it had some success.

Warb stepped up to the plate and started the thread.

With that call for help on this site it was hopefully inevitable that people would begin to try to raise the funds DAYV says he needs.

For a long while (going by the information DAYV gave us) there were only two people making donations.

Jay sent out his email in good faith and the number of donations increased which represents the generosity and compassion of people here that on nothing but trust they will give not only money but time and effort.

I was one of the many people who repeatedly asked DAYV to make some sort of evidence available, not because I didn't trust him but because, taking him at his word. he needed to raise a lot of money fast to get legitimate treatment (not apricot seeds and vitamins but radio or chemotherapy).

When you trust someone there is always the possibility they are not telling the truth, it would not be trust if you knew for certain they were telling the truth, trust is an act of faith in the words and intentions of another person.

If someone feels their trust has been betrayed that can be much worse in some circumstances than being out of pocket.

Like a number of people here I have a bit of time on my hands because I can't work anymore.

I have limited funds but when I read DAYV's posts I felt his needs were greater than my own and gave what I could.

My father died of cancer at around the age I am now and when I was DAYV's age I became seriously ill and almost died myself.

In my country the medical care that gave my father a good fighting chance and saved me are free of charge at the point of need because it's paid for out of taxation.

So when I read about DAYV I thought this was an opportunity in some small way to give something back.

When I first read doubts creeping in on this thread my heart sunk.

Either DAYV is still telling the truth and he still needs help to cure his cancer but he is less likely to get it now because of the shadow cast here or he hasn't got cancer (which is a relief) but he is so troubled that he needs attention and/or money enough that in desperation he will lie about something so painful to get it.

In either case it's tragic.

There is a side possibility that DAYV is just an evil jerk who will use any means necessary to get what he wants, I still don't believe that.

I've asked him in PM's before and I'm asking him here publicly, David if you do not have cancer now is the time to tell us .

If you were in a dark place and for whatever reason desperate for cash and in a spell of despair conjured up this story, face the music.

It will be hard and some people may never forgive you but I promise you it will eventually do you the world of good.

If you really have got cancer and I really hope you haven't but if you do find out how much it would cost to get another written verification from your doctor and I'll pay for it on the understanding that the actual document goes straight to Jay who can then send it back to you.

You don't need voodoo and vitamins will only go so far, you need proper medical attention and that costs money.

When you are sick and depressed handling paperwork can be tiring and having people doubt your story humiliating but it's understandable with so much fraud around that people will have doubts and if you are to raise the funds you need those doubts need to be lifted.

If you need other help, help with dealing with financial or emotional problems coming clean about that will open doors.

Burying your head in the sand will get you nowhere.

Whatever the case you have my sympathy and my best wishes.

***UPDATE***

I have been sent the same documents that Jay received and I can confirm they are exactly as he described.

It would be more conclusive if they were more detailed, dated and signed and I repeat my offer to pay for a dated letter confirming Dave's diagnosis which I feel would go some way to putting some donors and potential donors natural concerns to rest.

wow, I am confused all over again.    Dayv did send proof, but he is a graphic designer and could fake such stuff.   The time needed to created the faked documents could explain the delay.   But it is also possible he is telling the truth.    I have no problem believe the doctor's office would not tell Jay anything.  I worked for a year as a medical records clerk and I know they do not release any info to anyone but the patient and those the patient gives signed permission to release records to.    It might be possible for Dayv to go to the doctor's office and tell them that Jay has permission to access his medical records.  It might be possible to do that, I don't know for sure.   But I could also understand if Dayv would be reluctant to do so.   If he did so, Jay would have complete and total access to the medical records.  I don't know if I'd be willing to do that even if I did have cancer.   

Jay, one thing you could do see if this doctor's office has a website you could compare the letterhead design to that of the graphics on the website, I would think they should at least be similar in style and you could make sure the info on there matches what is on the letterhead Dayv sent you.   You could also ask the doctor's office to send you a blank letter head and compare that with what Dayv sent you.  They  may or may not do so, but it doesn't hurt to ask.   Finally if the doctor's office is willing,  you could send them what Dayv sent you and ask them to confirm whether it was sent from their office or not.    Again they may or may not be willing to do that.   Just some suggestions.

When I needed to make an insurance claim and have my student loan demands stopped the consultant treating me draughted a signed letter which had all the necessary details and was dated.

It would be useful to have such a document for general use anyway but it would certainly come in handy in this instance.

I have the same type of letter for my service dog, and also for my medical cannabis use.  All my doctor did was write a basic letter saying that I am under his care for a life threatening illness. The two of us signed it, giving a sort of limited permission to check up on this letter. The doctor will make a copy for his files. 

So now, If I go into a club to buy cannabis, the office staff of that club WILL call the doctor's office to see if I truly am under that doctor's care, and if that letter is legit. The doctor's office will give no further details. In a sense, the letter is the permission to verify I am under treatment of some kind.

Christ.  It doesn't need to be this complicated.  Either Dayv provides real, unadulterated proof, or he doesn't.  I'm of the belief that it is the latter.  If he REALLY has cancer, a simple phonecall to his doctor and a fax/phonecall to Jay is all that is needed.  If the so-called "documents" are dodging the issue, then they are fake.

if you can do that, I have no trouble believing you could create fake medical records.  Of course, for all I know,  they aren't fakes and are true medical records and you do have cancer.   So I don't know what to think right now.

Forgive me for getting involved in this, but "until there is irrefutable proof, we all have to think the worst" is fucking bullshit.  Whatever happened to innocent until proven guilty?  Now I agree that Dayv has been put under a burden to prove the veracity of his claims, which, by the way, I thought was a matter between Jay and Dayv, but so many people in this thread have done nothing but basically say, "I'm going to treat you like a criminal until you prove otherwise... asshole!"  I'm also not saying there hasn't been reason to be extremely suspicious, and I am quite interested to see what the truth to this situation is, but, JediTray, I think you're being extremely melodramatic.  Unless, of course, you donated money, requested a refund, and haven't been given it back.  In that case, I can certainly see you having a stronger, vested interest in it than most.  But until there is something along the lines of "irrefutable proof," can we please put down the fucking pitchforks?  But regardless of the outcome, this guilty until proven innocent mentality bullshit never needs to come up again!

You are absolutely RIGHT.

I have been in a few life-changing situations to say the least, and one of the WORST things to ever happen to me was being accused of something I did not do, and being treated like a criminal before anything could be done or proven otherwise.

I did donate and Dayv refunded me.

That said, Dayv, and everyone involved in this, I apologize.  It needs to be left up to the powers-that-be.  Chiming in with negative comments does NOTHING for anyone.

If this were just a matter of DAYV wanting donations for a project we would all assume he was actually working on a project, needed the money and donate as to our estimation of the merits of the project and our available funds.

Shawn of the Deli (a chap I'm only dimly aware of from my lurking days) has cast doubt over Dave having cancer.

When someone says they have cancer and need money we all assume it to be true but there is more of an imperative to raise money and fast than with a fan-edit or film preservation project.

It does strike me as a bit lopsided that Shawn hasn't been put under anything like the same sort of pressure to prove his counter claims but the unescapable fact is that for Dave to get what he says he needs from us he requires something relatively easy to obtain and something I'm prepared to pay for if there is a charge.

Dave has written in a PM to me that if you want to see the documents Jay and myself were sent you should ask him personally.

That is his prerogative so I shall not send them out or post them here.

Putting myself in the shoes of someone with cancer being constantly asked to prove himself I too would feel frustrated but as someone with a number of illnesses who has had to prove himself to insurance companies, to government officials etc on a regular basis it's a fact of life that you don't have to be guilty of something to be expected to produce appropriate documentation.

People with cancer need swift and regular treatment and that costs money and to raise money you need documentation to prove you need it.

That would be true of a charity or a government agency so it would make sense to get hold of such proofs either way.

It's not helpful to call people names and make judgements on the actions of someone based on the uncorroborated testimony of a single postee on this thread but if this money is needed documents of the kind described by myself and others will help raise those funds.

Not just here but in all manner of other agencies and fund raising groups.

That should be Dave's only focus, getting well.

I sympathize with you Gaffer, but here are few points to keep in mind

  1. Whose claim is easier to prove?  Dayv's claim that he has cancer or Shawn's claim that he does not?   Dayv's claim.    He can easily get a hold of records that prove it.    He could give the doctor's office permission to talk with Jay.   Just how would Shawn prove his claim?   He can't really unless Dayv confessed to him privately, which Shawn hasn't claimed.   Shawn doesn't really even know for a fact that Dayv doesn't have cancer, he just suspects it because Dayv never told him or his ex about it and never asked for donations on his own forum.    Also Shawn believes that is is Dayv's style to do this sort of thing to gain sympathy.   Just how would Shawn go about proving his claim?  He can't get access to any medical records that would prove it. If such records exist at all.  Just because you don't have cancer does not mean there are medical records that exist that prove you don't have Cancer.   It is almost impossible for Shawn to prove his claim.  Therefor, if we are to clear this up either way, the proof needs to come from Dayv. 
  2.  Who should have the most desire to clear this up?  Dayv.    If this is not cleared up and Dayv has cancer, and doesn't get the money and help needed to treat it , Dayv could die.   But what about Shawn?  All he risks is he reputation.     So Dayv should have much more of a desire to clear this up  than Shawn.   Yet he delayed and delayed and delayed.   Shawn's initial accusation came on 12/20/2010,  Jay's post that Dayv sent him records came on 01/06/2011.   That is a 17 day difference.  That seems very strange to me.    If I had cancer and I needed donations and was accused of lying,  I'd give Jay the proof within a week(if not sooner).  I'd be professing like crazy that I was innocent and I would probably demand that the accuser be banned.   Dayv does not seem to be acting like I would in the same situation.  Ask yourself if he is acting how you think an innocent person would act in this situation.
  3. Finally, this is not a court of law.    If it were, the burden of proof would most definitely be on Shawn.   This is a case a of a forum member asking for money to help treat his cancer.   Even if Shawn hadn't made his claim, each and every person on here would have the right to require whatever amount of proof they want before donating.  Heck, even if Dayv did proof concretely, no one would be required to donate.   Everyone has the right to decide for themselves under what conditions they will donate.

I, for one, come down on the side of innocent until proven guilty. I think Gaffer is right and the pitchforks need to be laid down.

At issue is the fact that Dayv has misrepresented some things in the past and has edited related posts. Whether the deception was intentional or not--and whether the edited posts are an attempt to clarify or cover up--is impossible to say, but once you get caught rewriting history, your integrity will always come into question.

As I said in my previous post, each of you must make your own determination. This isn't a court of law and Dayv isn't on trial.
