What does this mean for the fan edit community? Has the X0Project been jumped on like this?

I wonder if this is about the project or the site on myspace. I don't know for sure. Good luck...

It sounds like it's an attack on his myspace images. But hell, if that's the case, there's thousands of myspace users who have Star Wars images all over them. I sense a withchunt.
There's good in the Original Trilogy, and it's worth fighting for.

This is indeed a sad day. I really hope that this isn't just the beginning of a fan-based project crackdown. I have a feeling that it isn't though. Ane here's me reasons:

Myspace has become a promotional tool for films, bands and more and having a website on myspace about this project may have been seen by the "powers that be" at Lucasfilm as promoting Reborn to a wider audience than just the fan community.
By this letter, we request that you immediately suspend and/or disable the account of the above website and/or that you immediately remove the Unauthorized Items from the above website.

It seems in legal terms that they are only requesting that the website be removed but it doesn't state anywhere that you are not allowed to continue the project, just that you are not allowed to promote it in this manner. Myspace has become huge and it isn't just for star wars fans. Forums, like here at OT.com, are smaller and are less known outside the Star Wars community so any fan edits are not promoted in the same manner as they would be on MySpace or by having a specific website.

Personally, if i had received a letter like that, then i would continue with my project. As i mentioned earlier,it only mentions the website, not the edit. There were a few sites on myspace that were promoting fan edits for sale ( although they were saying that it was only to cover costs, which £10-£20 a shot is way above any costs). these were closed down pretty quick so maybe they are just clamping down on MySpace sites before anymore of these type of sites pop up.

I think that if it was just about the edit then we would be seeing Lucasfilm attempting to close down this site. I guess only time will tell

Hmm. An interesting development. Given the nature of my projects, I am often concerned about Lucasfilms perspective on such fan made films. To my knowledge they are happy for people to create their own films using copyrighted characters, but I think projects like mine, magnoliafan's, ADM's and yours (etc etc) have probably slipped through the net - until now.

Back in Aug 06 Lucas online published the following with regards to fan made spoofs and parodies:

"Lucasfilm has been informed that YouTube recently removed from its site several fan-made Star Wars spoofs and parodies. We would like the fan film community to know that this was not done at our request.

Apparently the action was taken by YouTube as a result of a misunderstanding of a request to remove an item containing material taken from starwars.com without our permission. We have asked YouTube to restore any works that they inadvertently removed."

Perhaps this latest development is the start of a crack down. Who knows. If I get a C&D notice from LFL I will absolutely and immediately stop what I am doing. I have total respect for their copyrights and for my personal position and finances for that matter.

Lucasfilm must be aware of our community and until now they have turned a blind eye. If we did contact them directly to clarify our positioin it would force them to quote the company line. Perhaps it's best to continue until we get a specific warning about our projects.

Lucasfilm knows sites like this exist. I mean, OCPMovie got several newspaper articles written about Deleted Magic, and in some of them I think he mentioned his classic editions, and Lucasfilm didn't seem to care. Magnolia Fan had a fairly high profile as well, and didn't get Lucasfilm after him. So it seems like they've taken a pretty lenient position to fan editing and preservations, as long as you don't go out and sell them, etc...

Bad news, but I agree with the post above saying that it is probably just in relation to the MySpace page and images on it. I mean, I think you linked to this site, so you would think that they would come here and pitch a huge fit if there was an issue with fan edits.

I understand your reluctance, though. Don't feel pressured to do anything you don't feel comfortable with. But, it would be nice to see this project realized someday.

Too bad about the myspace thing. I wonder if the SW dedicated blogs will get the same treatment. Part of the internet crackdown was based on parodies which were lewd or pornographic.

I say the fan edit should continue as long as you don't try to sell them. Which you won't, of course.

Well, I've remained quiet on here because I really needed to take a little time to gather my thoughts on this and decide whether or not we should proceed. What makes me livid is that there are millions of MySpace pages out there with Star Wars crap slathered all over it, copyrighted material out the yin-yang.... Why pick on ours?

While it appears that they're only focusing on the copyrighted material on the site, I think it's more of a warning that they're monitoring what TJ and I are doing. Unauthorized use of copyrighted materials is what they can get us on right now, and if we do end up releasing this thing, we might just get slapped with a lawsuit then and there for piracy or something worse.

I'm just a common working man who can't afford to get sued by a giant corporation like Lucasfilm, so I won't be taking any chances.

I think I made the mistake of venturing too far outside the fan community with this. I originally started the MySpace page for you guys, so you'd have a fun way to keep track of the progress of the edit. But as more and more people saw the trailers on YouTube, they were going to the site, and pretty soon the whole thing mushroomed. I had authors contacting me, sci-fi websites wanting to do interviews, I even had an editor who worked for Hardball with Chris Matthews at MSNBC contact me, saying the entire MSNBC newsroom in New York City was excited about the potential of the edit...

So, it's a real shame. And you guys can understand why I'm a little spooked. This isn't the most legal of hobbies we're engaging in, whether George Lucas says it's okay or not. His company's lawyers seem to have a different opinion.

I think the best thing for TJ and I to do is just lay low for a while, and at some point down the road it may find itself on a torrent site or something...

I understand you're decision, but I just have to say, the ESB trailer was one of the best trailers I've ever seen, including professional trailers. You really have great talent.

Dunno... I take from this that they were upset about your use of images, etc. on the myspace page. I really don't think they were talking about persuing legal action should they see your fan edit released to the community as a freely distributed fan activity. They have never once taken action against any of the other fan edits to hit the scene. I just think that your distribution of images and video via the myspace community got their attention. I have also heard of some of the many Labyrinth character myspace pages being contacted with a similar form letter. I understand your enthusiasm in wanting to get information about the edit out to those who might be interested beyond the ot.com community, but I do know that any myspace page that carries copywritten images can be hit. But I think it is a matter of someone very jealous of your talents ratting you out. Because I have heard numerous times that, much like eBay and unlike YouTube, myspace relies on its own members to police the activity of other members. They don't have a myspace police that sits there looking at pages to see who has copywritten images and who doesn't.

In any event, I hope you at least complete the edit for yourself as it seems a waste to simply let it die completely. And in a year or two when the heat dies down, like you said, perhaps it could hit the newsgroups or torrents, perhaps even under a different name so as not to directly tie it back to you.

Again, I completely understand your position as it is kind of scary to get your first C&D form letter, but I read it and all I see is that they didn't appreciate your "advertising" the project via myspace. The community here is one thing. While a fantastic and creative community, it is VERY small when all is considered by LFL. But when they see the thing being talked about within a community of 150 million plus, that takes things to a whole other level.

No matter what you decide, those were great trailers and I really hope to see the finished project in some form down the road.

More accurately a scare tactic by LFL, which is what it is. Myspace couldn't care less what its members do until the copyright holder comes knocking.

Mike Verta has a website dedicated to his Star Wars Legacy Edition. But in spite of promoting it, releasing video clips, and making suggestions to others, he has stated he will not release his edit.

You should emulate Mike.
