Tolkien borrowed plenty of things from plenty of different myths and legends. I think he would actually be proud that new writers and borrowing from the legend he wrote.

I agree with you that Tolkien's world is beyond Rowling's, but what scene in the first Harry Potter book mimics Bilbo riddling with Smaug? I can't think of one.
