Hmm, I looked into the whole Bilbo and dragon thing a little more. Actually that whole sequence is very similar to parts of Beowulf. Tolkien borrowed plenty of things from plenty of different myths and legends. I think he would actually be proud that new writers and borrowing from the legend he wrote.

However, Rowling will never reach the level of Tolkien. Tolkien's work is unique and will remain forever unsurpassed. You can no more create a work culturally or literarily more significant than Beowulf, Virgil's Aeneid, or Homer's Odyssey. Tolkien's work has made it. No matter what is written in the centuries to come, there will always be collage courses on Tolkien, there will always be Tolkien scholars, his original manuscripts will always be protected and treasured documents, a hundred years from now, when these stupid movies are forgotten and considered visually and esthetically outdated, people will still be reading the tale of Nine Fingered Frodo and the Ring of Doom. For this reason, no matter how many people try to copy his style, imitate his work, or even plain out steal whole sequences from his books, it will never bother me.
