The intertwined one is from the official DVD, which had the sword effects redone. I'd argue that while Vader's shows through (a badly done effect), the majority of the blade is Luke's on the correct side. The pic you posted is ambiguous, at best. I altered the curves on yours and it clearly shows Vader's sword between the Emperor and Luke's sword. I see no error in your pic.
