That was a different Captain Marvel, property of Marvel comics. I was talking about the original Captain Marvel who was first owned by Fawcett comics, who were sued by DC comics for copyright infringement on the ground that he was a rip off of Superman, and later DC bought the rights to that Captain Marvel when Fawcett went belly up.
MARVEL's Captain Marvel (the one that died of cancer - but I think there's been a new one or a couple of different ones since then)
The original/Fawcett Captain Marvel who is now owned by DC comics.
