Checked and looks like I had the wrong file, keeping all the working files in the same folder with the same name is not a good idea then...

I do not have the audio drift but it has the jerks, I think going with the 25fps and reconverting the FPS is the way forward anyone suggest a better program to convert?

depending on which file you want to make the framerate change with.

original h264 cap video - use eac3to
transcoded working video - use your nle if it can do it
final transcoded output file to h264 - use eac3to

Working on getting it perfect but just started a new job will update soon but no way I am taking it down again due to a bad encode from me :)
